L'obligation est un lien de droit permettant au créancier d'exiger du débiteur une prestation, positive ou négative. Le contrat est quotidiennement à la source d'obligations : vente, échange, louage, dépôt, prêt... Et nombre de questions se posent, concernant ses conditions et ses effets, les parties, les tiers et la société tout entière. Le législateur intervient souvent au secours du débiteur. Les obligations extra-contractuelles naissent le plus fréquemment d'accidents, longtemps liés à des fautes commises et connues, inhérents de plus en plus, par l'ampleur des dommages et l'exigence de réparation, à une société qui change.
Mais si la loi intervient, c'est surtout au secours du créancier. Les obligations sont soumises à des règles communes : le régime général des obligations. Comment le créancier obtient-il satisfaction d'un débiteur ? Quel pouvoir a-t-il sur ses biens ? A qui s'en prendre ? Les solutions varient selon les situations. L'obligation n'est ni immuable, ni éternelle. Elle peut être transmise - cession de créance, de dette, de contrat.
Tôt ou tard, elle s'éteint, souvent par l'effet d'un paiement, mais aussi autrement : compensation, novation, prescription... Constituant la "grammaire" du droit, le droit des obligations est la voie royale de la compréhension du juridique. Inchangé, pour l'essentiel, dans sa lettre, depuis 1804, le droit des obligations n'en avait pas moins connu de profondes mutations qui étaient principalement l'oeuvre de la jurisprudence, au point qu'on avait pu écrire qu'il était e hors le code Afin de remédier à cette situation, une ordonnance en date du 10 février 2016, ratifiée par une loi du 20 avril 2018, a réformé le droit commun des contrats et le régime général des obligations.
Paradoxalement, la réforme reste encore à faire, là où le besoin s'en faisait le plus sentir, c'est-à-dire en ce qui concerne la responsabilité civile extracontractuelle. A la lumière des textes nouveaux, les auteurs ont refondu en profondeur cet ouvrage dans ses parties relatives au droit commun des contrats, aux quasi-contrats et au régime général des obligations.
